El largo camino hacia la abolición global
Al finalizar 2010 no podía ser más evidente la tendencia mundial hacia la abolición de la pena de muerte. Mientras que a mediados de la década de 1990 se sabía que cada año una media de 40 países llevaba a cabo ejecuciones, durante los primeros años de este siglo se tuvo constancia de ejecuciones en 30 países por término medio.
Los informes más recientes indican que 25 países ejecutaron a personas encarceladas en 2008 y 19 en 2009, siendo esta última la cifra más baja registrada por Amnistía Internacional hasta la fecha. En 2010 se tuvo constancia de que se llevaron a cabo ejecuciones judiciales en no menos de 23 países. El número de países abolicionistas en la ley o en la práctica ha aumentado considerablemente en el último decenio, pasando de los 108 de 2001 a los 139 de estos últimos años.
Entre los países que más ejecuciones llevan a cabo, siguen destacando Arabia Saudí, China, Estados Unidos, Irán y Yemen, vulnerando en algunos casos de forma flagrante las normas internacionales de derechos humanos. Entre los métodos más utilizados en 2010 para llevar a cabo las ejecuciones, continuaron siendo la decapitación (Arabia Saudí), electrocución (Estados Unidos), ahorcamiento (Bangladesh, Botsuana, Corea del Norte, Egipto, Irak, Irán, Japón, Malaisia, Singapur, Siria, Sudán), inyección letal (China, Estados Unidos) y arma de fuego (Autoridad Nacional Palestina, Bahréin, Bielorrusia, China, Corea del Norte, Estados Unidos, Guinea Ecuatorial, Somalia, Taiwán, Vietnam, Yemen).
A pesar de que las ejecuciones pueden estar disminuyendo, en varios países continúan imponiéndose penas de muerte por delitos como los relacionados con drogas, los económicos, el mantenimiento de relaciones sexuales entre adultos con consentimiento mutuo y la blasfemia, en contra de lo dispuesto por las normas internacionales de derechos humanos que, excepto en el caso de los delitos más graves, prohíben el uso de la pena de muerte. Desgraciadamente, se continuó utilizando la pena de muerte con fines políticos, siendo ésta aplicada contra opositores políticos o para influir en la opinión pública en países como China o Irán.
En 2010 se dio un paso adelante en la restricción de la aplicación de la pena de muerte incluso en países en donde sigue existiendo un firme apoyo a la pena capital. El 20 de marzo, en Bangladesh se consideró inconstitucional la imposición preceptiva de esta pena sin tener en cuenta la situación personal de la persona acusada ni las circunstancias del delito concreto. El 30 de julio, en una resolución judicial histórica, el Tribunal de Apelaciones de Kenia falló que la pena de muerte preceptiva por asesinato era “contraria al espíritu y la letra de la Constitución”. En octubre de 2010, el Parlamento de Guyana aprobó una nueva ley que eliminaba la imposición preceptiva de la pena capital por asesinato. El 10 de marzo, el Comité de Derechos Humanos de la ONU concluyó que Zambia, en tanto que Estado Parte en el PIDCP, había incumplido sus obligaciones internacionales en materia de derechos humanos al imponer una condena a muerte.
El 21 de diciembre de 2010, la sesión plenaria de la Asamblea General de la ONU aprobó la tercera resolución sobre una moratoria del uso de la pena de muerte. La resolución, aprobada por 109 votos a favor, 41 en contra y 35 abstenciones, reitera las anteriores resoluciones 62/149 y 63/168 de la Asamblea General. El número de Estados miembros de la ONU que apoyaron la resolución en 2010 fue superior a los que votaron a favor de la de 2008. Bután, Kiribati, Maldivas, Mongolia y Togo cambiaron su voto con respecto a 2008 y apoyaron el llamamiento en favor de una moratoria sobre el uso de la pena de muerte. En una nueva muestra de los progresos alcanzados, Comoras, Dominica, Islas Salomón, Nigeria y Tailandia pasaron de la oposición a la moratoria manifestada en 2008 a la abstención en 2010. Por primera vez, la Federación Rusa y Madagascar copatrocinaron la resolución. En 2010, el número de votos en contra de la resolución disminuyó considerablemente, reflejando con ello la tendencia mundial hacia la eliminación del uso de la pena capital.
